9. Protection of personal data

9.1 Data controller

The data controller, within the meaning of the GDPR and the amended « Informatique et Libertés » law, is Dr Victor Médard de Chardon, practice at 101 rue d’Antibes, 06400 Cannes, France (telephone: +33 (0)4 93 68 86 68).

9.2 Data collected by the website, purposes and legal bases

  • Contact form: surname, first name, telephone, email, procedure concerned, message and, if you wish, up to 6 photos. This information is sent by email to the practice front desk in order to reply to your request; it is not stored on the website. The form is not intended to collect health data: any information and photos you choose to attach are processed with your explicit consent, given by ticking the box on the form (articles 6.1.a and 9.2.a of the GDPR).
  • Booking appointments: this is done on Doctolib, which processes the data needed for the appointment under its own privacy policy.
  • Audience measurement: see article 10 (Cookies).

Health data collected during consultations is processed in the medical record, outside this website: see article 9.8.

9.3 Recipients of the data

The data collected is intended exclusively for Dr Médard de Chardon and the authorised staff of the practice, strictly within the limits of their duties. No data is transferred, sold or rented to third parties.

Certain technical service providers (host, email provider, appointment booking provider) may access the data as processors within the meaning of article 28 of the GDPR. They are contractually bound to keep the data confidential and secure.

9.4 Retention period

Messages received through the contact form are kept by the practice for as long as necessary to deal with the request, then for no more than three (3) years from the last contact, unless they are added to your medical record. Data needed to comply with a legal obligation is kept for the period required by that obligation.

9.5 Transfers outside the European Union

If you accept audience measurement, certain technical data may be transferred outside the European Union by Google (see article 10). These transfers are governed by articles 44 et seq. of the GDPR, in particular by the European Commission’s standard contractual clauses and, for the United States, by Google LLC’s certification under the EU–US Data Privacy Framework. Apart from this audience measurement, no data is transferred outside the European Union.

9.6 Security

The data controller implements appropriate technical and organisational measures (TLS encryption, access controls, backups, staff awareness) to ensure the security and confidentiality of the data and to prevent any unauthorised access, loss, destruction or disclosure.

9.7 Your rights

In accordance with articles 15 to 22 of the GDPR and the amended « Informatique et Libertés » law, you have the following rights over your data: right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object on legitimate grounds, right to withdraw your consent at any time, and right to set instructions regarding what happens to your data after your death.

You can exercise these rights by contacting the data controller at secretaire@docteurmedarddechardon.com, or by post at 101 rue d’Antibes, 06400 Cannes, France. You will receive a reply within one (1) month of receipt of your request. Proof of identity may be requested if there is reasonable doubt as to your identity.

If, after contacting us, you consider that your rights have not been respected, you have the right to lodge a complaint with the Commission nationale de l’informatique et des libertés (CNIL, the French data protection authority) — 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France — www.cnil.fr.

9.8 Patients’ health data (medical record)

The website does not collect health data, other than any you choose to attach to the contact form (article 9.2). When you consult Dr Victor Médard de Chardon, however, the practice team collects the information needed for your care and records it in your medical record. This processing is based on article 9.2.h of the GDPR (preventive medicine, diagnosis and care).

Data collected, limited to what is necessary:

  • identity and contact details (surname, first name, address, telephone);
  • social security number (NIR) and health cover (Assurance Maladie, mutuelle);
  • information about your personal life that is relevant to your care (for example, the number of children);
  • health information (medical history, diagnoses, prescriptions, treatment, medical photographs) and the contact details of the other professionals who follow you.

Retention period: 20 years from the last consultation; for a minor, if this period ends before their 28th birthday, the record is kept until that date.

Medical confidentiality: it covers everything that has come to the surgeon’s knowledge in the course of his profession: not only what he has been told, but also what he has seen, heard or understood. The whole practice team is bound by it and has made a commitment to it by signing a confidentiality charter.

Security:

  • records hosted by a host certified as a “Hébergeur de données de santé” (HDS, certified health data host), on servers located in France;
  • no storage on tablets or phones;
  • password-protected computers, encrypted disks;
  • exchanges with other healthcare professionals through secure health messaging (MSSanté);
  • record of processing activities kept up to date.

Your rights over your record: you can access it and obtain a copy, add to it and have inaccurate information corrected. The record is provided no later than 8 days after your request, or 2 months if the information is more than 5 years old, and not before a 48-hour reflection period. Erasure is only possible once the statutory retention period has expired. To exercise these rights: secretaire@docteurmedarddechardon.com or by post at 101 rue d’Antibes, 06400 Cannes, France. You can also refer the matter to the CNIL (article 9.7).

  • Audience measurement — Google Analytics: the website uses Google Analytics, loaded by Google Tag Manager (services provided by Google Ireland Ltd), to measure audience and improve its content. These tools are only loaded after you have given your consent in the consent banner; without consent, no audience measurement cookie is placed.
  • Google map: on the Contact page, the Google Maps map is only loaded if you click “Show the map”; Google may then place its own cookies.

10.2 Managing your consent

You can change your choice at any time by clicking the “Manage cookies” link in the website footer. Your choice is kept for no more than 13 months, in line with CNIL recommendations; the banner is then shown to you again.

10.3 Transfers related to Google Analytics

These transfers are governed by the standard contractual clauses and by Google LLC’s certification under the EU–US Data Privacy Framework. You can withdraw your consent at any time using the “Manage cookies” link.
